Jolly re-indicted for drug possession in Houston case

GREEN BAY – Johnny Jolly thought his drug case in Houston was behind him.
He thought wrong.
The Green Bay Packers defensive end was re-indicted Tuesday on drug possession charges by a Harris County, Texas, grand jury.
Jolly, 26, was arrested in his native Houston on July 8, 2008, for possession of at least 200 grams of codeine. Houston police found cups containing codeine syrup in a vehicle driven by Jolly. The syrup is commonly mixed with soda to make a drink called “lean,” which originated in the Houston area.
Jolly was originally indicted by a grand jury on Oct. 1, 2008, but those charges were dropped on July 16. Donna Hawkins, a spokesperson for the Harris County Assistant District Attorney’s Office, said at the time that the dismissal was only temporary, because of questions surrounding how the Houston Police Department crime lab measured the amount of codeine in the evidence. The department was waiting for new, more accurate equipment, leading to the decision to drop the charges.
The arrival of that equipment allowed the police to test the evidence again – and more accurately – which in turn allowed the case to move forward, according to Donna Hawkins, a spokesperson for the.
Asked during training camp if he was concerned that the case could come up again, Jolly replied, “I ain’t worried. That’s behind me.”
The charges filed Tuesday are the same as they were initially. If convicted, Jolly could face up to 20 years in prison, although his first-time offender status could allow him to get probation. He is also subject to the NFL’s personal conduct policy and could be facing a league suspension as a result of the case, even if he is not convicted.
Jolly will have to turn himself in to Harris County authorities at some point, although when that will happen is unknown. The Packers play at Pittsburgh on Sunday with a chance to lock up an NFC playoff berth.
Jolly has been a vital cog on the Packers’ No. 2-ranked defense, ranking fourth on the team with 64 tackles while also contributing two sacks, an interception, two fumble recoveries, one forced fumble and eight pass deflections.
